General terms of delivery
General terms of delivery and payment of LAW OFFICE OF SELMA ÖREN, hereafter mentioned as the ‘Terms’.
Terms
These terms shall apply to all offers, assignments and agreements of the LAW OFFICE OF SELMA ÖREN. All of our agreements are based on these Terms. If any term or condition of a principal agreement conflicts with one of the Terms in question, then the Terms of the LAW OFFICE OF SELMA ÖREN shall prevail unless explicitly stated differently in the agreement with the client. A natural person or a corporation who requests legal services or who mandates the LAW OFFICE OF SELMA ÖREN will be mentioned hereafter as the client.
Offers/Honoraria
All of our offers are without engagement. Changes made by the client after the assignment is received, concerning the sort, degree and/or scope of the difficulty of the assignment, can result in the change of honorarium. Honoraria are valid for a maximum of 10 days, if no other validation is mentioned.
Assignment
The assignment will be executed properly and precisely by the LAW OFFICE OF SELMA ÖREN. The directions of the client will be taken into account as far as doing so is justified for the LAW OFFICE OF SELMA ÖREN.
Account
LAW OFFICE OF SELMA ÖREN shall be entitled to the agreed honorarium. If there is no agreement, the LAW OFFICE OF SELMA ÖREN shall charge the client an honorarium based on the prevailing custom in addition to the expenses attached to the execution of the agreement. On top of the honorarium, KDV (VAT) shall be charged. If the client’s assignment requires work after business-hours, the consultancy rates will double. Any change in the rates will be notified to the client in written one month beforehand.
Time
The time specified in the assignment request or in the agreement will be upheld and will taken into account; however, the LAW OFFICE OF SELMA ÖREN is not bound by it. For transgressions of the specified time, regardless of what the cause is, the client is by no means entitled to any compensation, to end the contract or to refuse to perform any commitment that should result from the agreement or from any other agreement that is in the context of this agreement. However, the LAW OFFICE OF SELMA ÖREN will contact the client when excessive transgression of the specified time is in question.
Withdrawal of the Assignment
The client is entitled to withdraw an assignment unilaterally. If the assignment is withdrawn at a time when the LAW OFFICE OF SELMA ÖREN has already carried out some work, the client shall owe the LAW OFFICE OF SELMA ÖREN indemnity according to the exigencies of the case, provided that the assignment is withdrawn due to reasons that cannot be imputed to the LAW OFFICE OF SELMA ÖREN. In that case, the LAW OFFICE OF SELMA ÖREN is entitled to the agreed fee or a fee that would have been reasonably charged at the time of the finalization of the assignment.
Payments
Unless otherwise agreed, the invoice shall be paid within 10 days after invoice is been send. According to the law, the client is deemed to be in default if the bill is not paid within the specified time. The LAW OFFICE OF SELMA ÖREN is then entitled to charge 2% interest over the total amount due from the expiry date without putting the client in default. In addition, all judicial and non-judicial collecting charges will be at the client’s cost.
Administrative and Other Related Costs
Our administration costs on the total amount of fee is 6%.
Costs due to litigation , notary , sworn translation, international dispatch by courier and any kind of taxes or charges to be paid to third parties are not included in our charged administration costs.
Please consider possibly cost that could be applied.
All our fees and charges are exclusive VAT of 20%.
Responsibility
The LAW OFFICE OF SELMA ÖREN is not responsible for any damage that the client endures as a result of not correctly carrying out the assignment unless the damage is caused deliberately by the LAW OFFICE OF SELMA ÖREN.
The LAW OFFICE OF SELMA ÖREN is not responsible for any damage that the client endures as a result of not correctly carrying out the assignment in case the specified time is not reasonably proportionate to the scope of the work to be carried out. The scope of the responsibility of the LAW OFFICE OF SELMA ÖREN per assignment does not extend further than what is covered in the whole amount that is charged to the client. The LAW OFFICE OF SELMA ÖREN is by no means responsible for any damage caused by the loss, destruction or injury to scripts, documents, books and papers that has been entrusted to the LAW OFFICE OF SELMA ÖREN. The clients send the above-mentioned at their own cost and risk.
